These Terms set out the rules for using Fancy AI at fancyai.net. Please read them carefully before you start chatting.
1. Acceptance of These Terms
By accessing fancyai.net you agree to these Terms of Service. If you do not accept them, please stop using Fancy AI.
2. Eligibility and Age
Fancy AI is intended for adults aged 18 years or older. By using the site you confirm that you meet this requirement and that doing so is lawful where you live.
3. Nature of the Service
Fancy AI presents fictional characters created for entertainment and companionship. The characters are not real people and no statement made by a character should be treated as fact.
4. No Professional Advice
Nothing on Fancy AI constitutes medical, psychological, legal, financial or other professional advice. If you need such advice, consult a qualified professional.
5. Crisis Situations
Fancy AI is not an emergency or crisis service. If you are in danger or in distress, contact local emergency services or a recognised support line immediately.
6. Account Responsibility
Where an account is created, you are responsible for the accuracy of the details you provide and for all activity that takes place under your access credentials.
7. Acceptable Use
You agree to use Fancy AI lawfully and respectfully. In particular you must not:
- attempt to interfere with or disrupt the site
- use automated tools to scrape or harvest content
- impersonate another person or entity
- upload malicious code of any kind
- attempt to gain unauthorised access to any system
8. Prohibited Content
You must not submit content that is unlawful, that involves minors in any sexual context, that promotes violence or hatred, or that infringes the rights of others. Violations may result in immediate termination.
9. Content You Submit
You retain responsibility for what you write. By submitting content you confirm that you have the right to do so and that it does not breach these Terms.
10. Licence to Operate
You grant Fancy AI a limited licence to process the content you submit solely to operate and improve the service described on this website.
11. Intellectual Property
The Fancy AI name, character profiles, written material, imagery, layout and code are owned by Fancy AI or its licensors and are protected by applicable intellectual property law.
12. Restrictions on Use of Materials
You may not copy, republish, resell or create derivative works from Fancy AI materials without prior written permission.
13. Character Imagery
Imagery presented alongside Fancy AI characters is illustrative and depicts fictional personas. It does not represent real individuals available for contact.
14. Availability
We aim to keep Fancy AI available continuously, but access may be interrupted for maintenance, technical failure or reasons outside our control. Availability is not guaranteed.
15. Changes to the Service
We may add, modify or remove features of Fancy AI at any time, including characters, pages and access tiers.
16. Paid Access
Where paid access is offered, the price, billing period and included features are shown before purchase. Charges recur until cancelled if the offer states that it renews.
17. Renewals and Cancellation
You may cancel a recurring plan at any time before the next renewal date. Cancellation stops future charges and access continues until the end of the paid period.
18. Refunds
Except where the law requires otherwise, payments already collected are non-refundable. Billing errors reported promptly will be reviewed and corrected.
19. Third-Party Services
Fancy AI may link to or rely on third-party services. Those services are governed by their own terms and we accept no responsibility for them.
20. Privacy
Our handling of information is described in the Fancy AI Privacy Policy, which forms part of these Terms.
21. Disclaimer of Warranties
Fancy AI is provided on an 'as is' and 'as available' basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
22. Limitation of Liability
To the extent permitted by law, Fancy AI is not liable for indirect, incidental, special or consequential loss, including loss of data, profit or goodwill arising from use of the site.
23. Maximum Liability
Where liability cannot be excluded, our total liability is limited to the amount you paid to Fancy AI in the three months preceding the event giving rise to the claim.
24. Indemnity
You agree to indemnify Fancy AI against claims, damages and reasonable costs arising from your breach of these Terms or your misuse of the site.
25. Suspension and Termination
We may suspend or terminate access to Fancy AI where these Terms are breached, where use is unlawful, or where continued access would harm other users or the service.
26. Consequences of Termination
On termination your right to use Fancy AI ends immediately. Provisions that by their nature should survive, including intellectual property and liability clauses, remain in force.
27. Force Majeure
Fancy AI is not responsible for failure to perform caused by events beyond reasonable control, including network failures, natural events and acts of public authorities.
28. Governing Law
These Terms are governed by the laws applicable at the place of establishment of Fancy AI, without regard to conflict of law rules.
29. Dispute Resolution
Before starting formal proceedings, please contact us so that we can attempt to resolve the matter directly. Most issues can be settled quickly this way.
30. Severability and Entire Agreement
If any provision is held unenforceable, the remaining provisions continue in force. Together with the Privacy Policy, these Terms form the entire agreement between you and Fancy AI.
31. Updates to These Terms
We may revise these Terms. The revision date shown above indicates the current version, and continued use of Fancy AI after an update means you accept the revised Terms.
